BISCOTTI NINETY (90) DAY LIMITED WARRANTY Biscotti Inc. (Biscotti) warrants the Biscotti electronic device (Product) to the original purchaser (you) against defects in materials and workmanship under normal use for a period of ninety (90) days from the date of original purchase (Warranty Period). You may not transfer this warranty. If a defect occurs and a valid claim is received by Biscotti within the Warranty Period, Biscotti will, at its option, either (1) repair the hardware defect using new or refurbished parts, (2) exchange the Product with a new or refurbished product that is at least functionally equivalent to the original Product, or (3) refund the purchase price of the Product. Replaced or repaired Products assume the remaining Warranty Period of the original Product, or thirty (30) days from the date of replacement or repair, whichever is longer. When a Product is exchanged, any replacement Product becomes your property and the replaced Product becomes Biscottis property. When a refund is given, you must return the Product at your expense, and it becomes Biscottis property. Warranty Service To obtain warranty service, first visit the Biscotti website (www.Biscotti.com/warrranty) or write to Biscotti Inc. 700 Central Expressway South, Suite 240, Allen, TX 75013. You will be required to deliver the Product, freight prepaid, in its original packaging or packaging providing an equal degree of protection, to the address specified by Biscotti. In accordance with applicable law, Biscotti may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service. Exclusions This warranty does not apply: (a) to any software or any non-Biscotti hardware products, even if packaged or sold with the Product (refer to the applicable software license for details of your rights with respect to use of software), (b) to consumables (such as batteries); (c) to defects caused by normal wear and tear;
(d) to cosmetic damage (such as scratches and dents); (e) to damage caused by use with non-Biscotti products; (f ) to damage caused by liquids, accident, abuse, misuse, fire or other external causes; (g) to damage caused by failure to follow the Product instructions or use not intended by Biscotti; or (h) to damage caused by unauthorized service. Biscotti does not warrant that the operation of the Product will be uninterrupted or error-free. Limitations THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN. TO THE EXTENT PERMITTED BY LAW, ALL STATUTORY AND IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE WARRANTY PERIOD. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE LIMITATION MAY NOT APPLY TO YOU.BISCOTTI IS NOT RESPONSIBLE FOR CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL OR OTHER NON-DIRECT DAMAGES RESULTING FROM ANY BREACH OF THIS WARRANTY UNDER ANY LEGAL THEORY, INCLUDING BUT NOT LIMITED TO, LOSS OF USE, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF OPPORTUNITY, LOSS OF GOODWILL, OR LOSS OF DATA, HOWSOEVER CAUSED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. No Biscotti reseller, agent, or employee is authorized to make any modification to this warranty. If any term of this warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
