InCoax guarantees that the Hardware Products that you have purchased or leased from InCoax are free from defects in materials or workmanship under normal use during the Limited Warranty Period. The Limited Warranty Period starts on the date of purchase or lease from InCoax, it is valid for 13 months and you fully accept the InCoax Limited Warranty Conditions at purchase. Your dated sales or delivery receipt, showing the date of purchase or lease of the product, is your proof of the purchase or lease date. You may be required to provide proof of purchase or lease as a condition of receiving warranty service. You are entitled to hardware warranty service according to the terms and conditions of this document if a repair to your Hardware Product is required within the Limited Warranty Period. During the Limited Warranty Period, InCoax will, at its discretion, repair or replace any defective component. All compo-

nent parts or hardware products removed under this Limited Warranty become the property of InCoax. In the unlikely event that your Hardware Product has recurring failures, InCoax, at its sole discretion, may elect to provide you with:

a) A replacement unit of InCoax choosing that is the same or equivalent to your Hardware Product in performance or b) To give you a refund of your purchase price or lease payments (less interest) instead of a replacement. These are your only alternatives for defective products. It is mandatory that the product number and serial number of the unit be made available when requesting a warranty service event. Failure to do so may result in the event being deemed out of warranty by InCoax or, InCoax Authorized Service Providers, and therefore chargeable to the requester. Unless otherwise stated, and to the extent permitted by local law, new Hardware Products may be manufactured using new materials or new and used materials equivalent to new in performance and reliability. InCoax may repair or replace Hardware Products:

a) With new or previously used products or parts equivalent to new in performance and reliability, or b) With equivalent products to an original product that has been discontinued Replacement parts are warranted to be free from defects in material or workmans-

hip for ninety (90) days or, for the remainder of the Limited Warranty Period of the Hardware Product they are replacing or in which they are installed, whichever is longer. Notes:

I. Firmware upgrades are not covered under this InCoax Limited Warranty Conditions. Firmware that is an integral part of the hardware is not automatically upgraded when new versions of the firmware are released. II. Firmware upgrades can be purchased as part of Support Services according to actual Price List. III. Hardware Replacement can be purchased as part of the Support Service accor-

ding to the actual Price List. EXCLUSIONS InCoax does not guarantee that the operation of this product will be uninterrupted or error-free. InCoax is not responsible for damage that occurs as a result of your failure to follow the instructions intended for Hardware Product(s). This Limited Warranty does not apply to expendable or consumable parts and does not extend to any product from which the serial number has been removed, damaged or rendered defective. Furthermore, the Limited Warranty is not applicable for the following:

a) As a result of accident, misuse, abuse, contamination, improper or inadequate maintenance or calibration or other external causes. b) By operation outside the parameters stated in the user documentation that is shipped with the product (including incorrect input voltage or voltage peaks caused by lightning). c) Improper site preparation or maintenance. d) Virus infection of the software and/or firmware. e) Loss or damage in transit. f) By modification or service by anyone other than:

I. InCoax II. An InCoax authorized service provider InCoax is not responsible for any interoperability or compatibility issues that may arise when:

1. Products, software, or options not supported by InCoax are used. 2. Configurations not supported by InCoax are used. 3. Parts intended for one system are installed in another system of different make or model. LIMITATION OF LIABILITY If the Hardware Product fails to work as warranted above, InCoax maximum liabili-

ty under the Limited Warranty is expressly limited to the lesser of the price paid for the Product or the cost of repair or replacement of any hardware components that malfunction in conditions during normal use. In no event will InCoax be liable for, except as indicated above, any damages caused by the Product or the failure of the Product to perform, including any lost profits or savings, business interruption, loss of use or any other commercial or economic loss of any kind, or special, incremental, or consequential damages. InCoax is not liable for any claim made by a third party or made by you for the third party. This limitation of liability applies whether damages are sought, or a claim made, under this limited warranty or as a tort claim (including negligence and strict product liability), a contract claim or any other claim. This limitation in liability cannot be waivered or amended by any person. This limitation of liability will be effective even if you have advised InCoax, or an authorized representative of InCoax, of the possibility of any such damages or even if such possibility were reasonably foreseeable. This limitation of liability, however, will not apply to claims for personal injury. This limited liability gives specific legal rights. You may also have other rights that may vary from state to state or from country to country. You are advised to consult applicable state or country laws for a full determination of rights. If InCoax determines that damage/

failure that exists is not covered by the warranty the end user will be contacted to determine whether such damage/failure should be repaired for a charge or whether the Hardware Product should be returned to the end user as received. All associated transportation and handling costs are charged to the customer. CUSTOMER RESPONSIBILITIES To enable InCoax to provide the best possible support and service during the Limited Warranty Period, you will be required to:

Maintain a proper and adequate environment, and use the Hardware Product in accordance with the given instructions. Verify configurations, load the most recent firmware, install software patches, run InCoax diagnostics and utilities, and implement temporary procedures or work-

arounds provided by InCoax while InCoax works on permanent solutions. Allow InCoax to keep resident on your systems or sites certain system and network diagnostics and maintenance tools to facilitate the performance of warranty support. Provide remote connectivity through an InCoax-approved communications line, if required. Assist InCoax in running the service tests. Use the electronic data transfer capability to inform InCoax of events identified by the software. Purchase InCoax-specified remote connection hardware for systems with remote diagnosis service, if required. Use InCoax remote support solutions where applicable. InCoax strongly encourages you to use the available support technologies provi-

ded by InCoax. If you choose not to deploy available remote support capabilities, you may incur additional costs due to increased support resource requirements. It is recommended to cooperate with InCoax in attempting to resolve the problem over the telephone or e-mail. This may involve performing routine diagnostic procedures, installing additional software updates or patches, removing third-party options, and/or substituting options. You should maintain a procedure to reconstruct your lost or altered files, data, or programs that is not dependent on the Hardware Product under warranty support. Notify InCoax if you use Hardware Products in an environment that poses a potential health or safety hazard to InCoax employees or subcontractors. InCoax may require you to maintain such products under InCoax supervision and may postpone warranty service until you remedy such hazards. InCoax may request that you perform additional tasks as defined within each type of warranty service listed above and any other actions that InCoax may reasonably request in order to best perform the warranty support. SOFTWARE LIMITED WARRANTY Except as provided in the applicable software end-user license or program license agreement, or if otherwise provided under local law, software products, including any freeware (as defined below) or operating systems preinstalled by InCoax are provided AS IS and with all eventual faults, and InCoax hereby disclaims all other warranties and conditions, either express, implied, or statutory, including, but not limited to, warranties of title and non-infringement, any implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, and lack of software viruses. Some states/jurisdictions do not allow exclusion of implied war-

ranties or limitations on the duration of implied warranties, so the above disclaimer may not apply to you in its entirety. To the maximum permitted by applicable law, in no event shall InCoax or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever. Under den begrnsade garantiperioden kommer InCoax, efter eget gottfinnande, att reparera eller byta ut defekta delar. Alla komponenter eller hrdvaruprodukter som tas bort under denna begrnsade garanti blir InCoax egendom. Om din hrdvaruprodukt mot all frmodan skulle uppvisa terkommande fel kan InCoax, efter eget gottfin-

nande, vlja att ge dig ett av fljande alternativ:

a) En ersttningsprodukt vald av InCoax som liknar eller motsvarar den hrdva-

ruprodukt du kpt eller hyrt. b) Pengarna tillbaka fr kpet eller hyreskostnaderna (minus rnta) i stllet fr ett utbyte. I hndelse av en defekt produkt r detta dina enda val fr kompensation. Vid frfrgan om garantiservice mste alltid enhetens produktnummer och serie-

nummer finnas tillgngliga och kunna anges. Om begrda uppgifter inte kan ges, kan detta innebra att rendet inte fr tas p garantin hos InCoax eller av InCoax auktoriserade serviceleverantrer och att kunden sjlv fr st fr kostnaden. Om inget annat anges, och i den utstrckning som r tilltet enligt gllande lag, kan nya hrdvaruprodukter tillverkas av nya material eller nya och anvnda material som motsvarar nya i prestanda och tillfrlitlighet. InCoax kan reparera eller byta ut hrdvaruprodukter:

a) Med nya eller tidigare anvnda produkter eller delar som motsvarar nya i pre-

standa och tillfrlitlighet, eller b) Med produkter som motsvarar en originalprodukt som har utgtt. Reservdelar garanteras vara felfria i material och utfrande under nittio (90) dagar eller under terstoden av den begrnsade garantiperioden fr den hrdvarupro-

dukt som byts ut eller i vilken delarna installeras, beroende p vad som intrffar frst. Observera:

I. Uppdateringar av inbyggd programvara tcks inte av villkoren fr den begrn-

sade garantin fr InCoax produkter. Programvara som r integrerad i hrdvaran uppdateras inte automatiskt nr det slpps nya versioner av programvaran. II. Uppdateringar av inbyggd programvara kan kpas som en del av support-

tjnster enligt aktuell prislista III. Reservdelar fr hrdvaran kan kpas som en del av supporttjnster enligt aktuell prislista. UNDANTAG InCoax garanterar inte att produktens drift kommer vara helt fri frn avbrott eller fel. InCoax ansvarar inte fr skador som uppstr till fljd av att anvndaren inte har fljt de instruktioner som gller fr hrdvaruprodukter. Den begrnsade garantin gller inte frbrukningsdelar och inte en produkt som har ett borttaget, skadat eller olsligt serienummer. Dessutom gller den begrnsade garantin inte:

a) Till fljd av en olycka, felaktig anvndning, missbruk, nedsmutsning, felaktigt eller otillrckligt underhll eller kalibrering eller andra externa orsaker. b) Vid anvndning utanfr de anvndarparmetrar som anges i bruksanvisningen som medfljer produkten (inklusive felaktig ingngsspnning eller spnningstoppar orsakade av skvder). c) Vid felaktiga frberedelser p installationsplatsen. d) Vid infektion av datavirus fr program (tillmpnings- svl som system-) och/eller fast programvara. e) Vid frlust eller skador under transport. f) Vid ndringar eller service av ngon annan n:

Anvnda mjligheten till elektronisk dataverfring fr att informera InCoax om hndelser som registreras av programvaran. Kpa hrdvara specificerad av InCoax fr fjrranslutning av system med fjrrdiag-

nostjnster om detta behvs. Anvnda InCoax fjrrsupportlsningar nr det r mjligt. InCoax rekommenderar starkt att du anvnder tillgnglig supportteknik som tillhandahlls av InCoax. Om du vljer att inte anvnda tillgngliga mjligheter till fjrrsupport, kan det tillkomma extra kostnader om supporten krver extra resurser. Samarbeta med InCoax vid problemlsning ver telefon eller via e-post. Detta kan innebra krning av rutindiagnostikprocesser, att installera ytterligare programuppdateringar eller tillgg, ta bort alternativ frn tredje part och/eller byta ut alternativ. beitungs- oder Materialmngeln sind. Die Laufzeit der Begrenzten Garantie beginnt am Tag des Kaufs oder des Beginns des Leasings bei der InCoax und gilt 13 Mona-

te, und Sie akzeptieren diese Bedingungen der Begrenzten Garantie der InCoax in vollem Umfang beim Kauf. Ihre Kaufquittung oder Ihr Lieferschein, der das Datum des Kauf bzw. des Beginns des Leasings ausweist, ist Ihr Beleg fr das Kauf- bzw. Leasingdatum. Als Voraussetzung fr einen Garantieservice kann von Ihnen die Vorlage eines Kauf- bzw. Leasingsbelegs verlangt werden. Sie sind zu einem Hard-

ware-Garantieservice nach den Bedingungen diese Dokuments berechtigt, wenn bei Ihrem Hardwareprodukt whrend der Laufzeit der Begrenzten Garantie eine Reparatur erforderlich wird. Whrend der Laufzeit der Begrenzten Garantie wird die InCoax nach ihrem Ermessen jedes defekte Teil reparieren oder auswechseln. Alle nach dieser Begrenzten Garantie ausgebauten Teile oder Hardwareprodukte gehen in das Eigentum der InCoax ber. In dem unwahrscheinlichen Fall, dass Ihr Hardwareprodukt von wiederholten Mngeln betroffen ist, kann Ihnen die InCoax nach ihrem Ermessen Folgendes anbieten:

a) ein Ersatzgert nach Wahl der InCoax, das im Hinblick auf die Leistung mit Ihrem Hardwareprodukt identisch oder gleichwertig dazu ist; oder b) die Rckerstattung Ihres Kaufpreises oder Ihrer Leasingzahlungen (abzglich Zinsen) anstatt eines Ersatzgerts. Im Rahmen der Garantie stehen Ihnen ausschlielich diese Abhilfen zur Verfgung. Wenn Sie einen Garantieservice verlangen, ist es zwingend erforderlich, dass Sie die Produktionsnummer und die Seriennummer des Gerts angeben. Wenn Sie das nicht tun, besteht die Gefahr, dass der Service von der InCoax oder denjenigen, die von der InCoax zur Serviceleistung autorisiert sind, als auerhalb der Garantie liegend angesehen und Ihnen daher in Rechnung gestellt wird. Wenn nichts anderes angegeben ist und in dem nach den lokalen Gesetzen zulssigen Umfang knnen Hardwareprodukte unter Verwendung neuer Materialien oder neuer und gebrauchter Materialien hergestellt werden, die neuen nach Leistung und Zuver-

lssigkeit gleichwertig sind. Die InCoax kann Hardwareprodukte reparieren oder auswechseln gegen:

a) neue oder vorher verwendete Produkte oder Teile, die neuen nach Leistung und Zuverlssigkeit gleichwertig sind; oder b) Produkte, die zu einem Originalprodukt, das nicht mehr hergestellt wird, gleichwertig sind. Bei Ersatzteilen wird garantiert, dass sie neunzig (90) Tage oder die verbleibende Laufzeit der Begrenzten Garantie des Hardwareprodukts, das sie ersetzen oder in das sie eingebaut werden, je nachdem, was lnger ist, frei von Material- oder Verarbeitungsmngeln sind. Hinweise:

I. Firmware-Aktualisierungen fallen nicht unter diese Begrenzte Garantie der InCoax. Firmware, die ein integraler Teil des Hardware-Boards ist, wird nicht auto-

matisch aktualisiert, wenn neue Versionen erscheinen. II. Firmware-Aktualisierungen knnen im Rahmen eines Supportservice gem der aktuellen Preisliste erworben werden. III. Hardware-Ersatzteile knnen im Rahmen eines Supportservice gem der aktuellen Preisliste erworben werden. AUSNAHMEN Die InCoax garantiert nicht, dass der Betrieb dieses Produkts ununterbrochen oder fehlerfrei sein wird. Die InCoax ist nicht fr Schden verantwortlich, die auftreten, weil Sie die fr das Hardwareprodukt (die Hardwareprodukte) bestimmten Anweisungen nicht befolgt haben. Die Begrenzte Garantie gilt nicht fr Versch-

leiteile und Verbrauchsmaterial sowie fr Produkte, bei denen die Seriennummer entfernt, beschdigt oder unbrauchbar gemacht wurde; sie gilt weiterhin nicht fr Schden, die die Folge a) eines Unfalls, Fehlgebrauchs, Missbrauchs, einer Kontaminierung, un zweck-

migen oder unzureichenden Wartung oder Eichung sind bzw. andererexterner Ursachen sind;

b) eines Betriebs sind, der sich auerhalb der Gebrauchsparameter bewegt, die in der mit diesem Produkt mitgeliefert Benutzerdokumentation aufgestellt werden

(einschlielich einer falschen Eingangsspannung oder Spannungsspitzen durch Gewitter);

c) einer unzureichenden Vorbereitung des Einsatzortes oder unzureichender Wartung sind;

d) einer Virusinfektion sind;

e) eines Verlusts oder einer Beschdigung beim Transport des Gerts sind;

f) einer Abnderung oder eines Service sind, der von jemand anderem durch-

gefhrtwurde als I. der InCoax II. eines von der InCoax zur Serviceleistung Autorisierten. Die InCoax ist fr jegliche Probleme mit der Interoperabilitt oder Kompatibilitt nicht verantwortlich, wenn diese auftreten, wenn:

1. Produkte, Software oder Optionen verwendet werden, die nicht von der InCoax untersttzt werden;

2. Konfigurationen verwendet werden, die nicht von der InCoax untersttzt werden;

3. Teile, die fr ein System gedacht sind, in einem anderen System anderer Machartoder einem anderen Modell eingebaut werden. HAFTUNGSBESCHRNKUNG Wenn das Hardwareprodukt nicht so funktioniert, wie oben garantiert, ist die maximale Haftung der InCoax nach der Beschrnkten Garantie ausdrcklich auf weniger als den fr das Produkt gezahlten Preis oder die Kosten der Reparatur oder des Ersatzes von Hardwarekomponenten begrenzt, bei denen bei normalem Gebrauch eine Fehlfunktion aufgetreten ist. Die InCoax haftet auer in den oben angegebenen Fllen unter keinen Umstnden fr Schden, die durch das Produkt oder den Leistungsausfall des Produkts verursacht worden sind, einschlielich entgangener Gewinne oder Ersparnisse, Geschftsunterbrechungen, Gebrauch-

sausfall oder anderer kommerzieller oder wirtschaftlicher Verluste jeglicher Art oder besonderer Schden, Mehrkosten oder Folgeschden. Die InCoax haftet nicht fr Ansprche, die von einem Dritten oder von Ihnen fr einen Dritten erhoben werden. Diese Haftungsbegrenzung gilt sowohl dann, wenn Schadensersatz geltend gemacht oder ein Anspruch nach dieser Begrenzten Garantie oder ein deliktischer Anspruch (einschlielich aufgrund von Fahrlssigkeit und verschul-

densunabhngiger Produkthaftung), ein vertraglicher oder ein Anspruch anderer Art erhoben wird. Auf diese Haftungsbegrenzung kann von niemandem verzichtet und sie kann von niemandem abgendert werden. Diese Haftungsbegrenzung gilt selbst dann, wenn Sie die InCoax oder einen bevollmchtigten Vertreter der InCoax auf die Mglichkeit solcher Schden hingewiesen haben oder diese Mglichkeit angemessen vorhersehbar war. nen auch andere Rechte haben, die von Bundesland zu Bundesland und von Land zu Land verschieden sein knnen. Wenn die InCoax feststellt, dass der vorhandene Schaden/Mangel nicht durch die Garantie abgedeckt ist, wird sie Kontakt zu dem Endbenutzer aufnehmen, um zu entschieden, ob dieser Schaden/Mangel kostenpflichtig repariert oder das Hard-

wareprodukt so an den Endbenutzer zurckgesandt werden soll, wie es empfangen wurde. Alle damit verbundenen Transport- und Bearbeitungskosten werden dem Kunden in Rechnung gestellt. VERANTWORTLICHKEITEN DES KUNDEN Damit die InCoax whrend der Laufzeit der Begrenzten Garantie den bestmg-

lichen Kundendienst leisten kann, wird von Ihnen verlangt, dass Sie:

Eine ordnungsgeme und angemessene Umgebung aufrechterhalten und das Hardwareprodukt gem den gegebenen Anweisungen verwenden. Konfigurationen berprfen, die neueste Firmware laden, Softwarepatchesin-

stallieren, das Diagnose- und Dienstprogramm von InCoax ausfhren und von der InCoax bereitgestellte bergangsverfahren oder Umgehungslsungen implementi-

ere, whrend die InCoax an dauerhaften Lsungen arbeitet. Es der InCoax gestatten, auf Ihren Systemen oder Orten bestimmte System- und Netzwerkdiagnose- und Wartungswerkzeuge bereitzuhalten, um die Durchfhrung des Garantiekundendienst zu erleichtern. Falls erforderlich eine Fernanbindung ber eine von der InCoax genehmigte Kommunikationsleitung zur Verfgung stellen. Die InCoax bei der Durchfhrung von Servicetests untersttzen. Die Mglichkeit zum elektronischen Datentransfer nutzen, um die InCoax bervon der Software erfasste Ereignisse zu informieren. Falls erforderlich von der InCoax spezifizierte Hardware zur Fernanbindung fr Systeme mit Ferndiagnosedienst kaufen. Fernlsungen der InCoax verwenden, wo diese anwendbar sind. Die InCoax ermutigt Sie nachdrcklich dazu, von der InCoax bereitgestellte Hilfetechnologien zu verwenden. Wenn Sie sich dazu entscheiden, verfgbare Mglichkeiten der Fernuntersttzung nicht anzuwenden, knnen Ihnen aufgrund eines hheren Ressourceverbrauchs durch den Kundendienst zustzliche Kosten entstehen. Mit InCoax bei dem Versuch, das Problem zu lsen, ber Telefon oder E-Mail zusam-

menarbeiten. Dazu knnen die Durchfhrung von Verfahren zur routinemigen Diagnose, die Installation zustzlicher Softwareaktualisierungen oder -patches, das Entfernen von Optionen Dritter und/oder die Ersetzung von Optionen gehren. Ein Verfahren zur Wiederherstellung Ihrer verlorenen oder vernderten Dateien, Daten oder Programme pflegen, das nicht von dem der Garantieuntersttzung unterliegenden Hardwareprodukt abhngig ist. Die InCoax benachrichtigen, wenn Sie Hardwareprodukte in einer Umgebung verwenden, die fr die Mitarbeiter oder Subunternehmer der InCoax eine potenzielle Gesundheits- oder Sicherheitsgefahr darstellt. Die InCoax kann verlangen, dass Sie diese Produkte unter der Aufsicht der InCoax warten und kann den Garantieservice zurckhalten, bis Sie diese Gefahren behoben haben. Zustzliche Aufgaben, so wie sie in der jeweiligen unten aufgefhrten Art von Garantieservice festgelegt sind, und eventuelle andere Manahmen treffen, die die InCoax angemessenerweise verlangen kann, um den Garantieservice auf beste Weise durchzufhren. Einige Bundeslnder/Staaten lassen einen Ausschluss von impliziten Garantien oder Begrenzungen der Laufzeit impliziter Garantien nicht zu, weshalb es sein kann, dass die vorstehende Haftungsfreizeichnung auf Sie nicht im vollen Umfang zutrifft. den, indirekte Folgeschden welcher Art auch immer (einschlielich, ohne darauf begrenzt zu sein, Schadensersatz fr entgangenen Gewinn oder vertrauliche oder andere Informationen, fr Betriebsunterbrechungen, Personenschden, den Verlust der Privatsphre infolge der Verwendung des Softwareprodukts oder im Zusammenhang damit oder etwaigen Nutzungshindernissen in Bezug auf dasselbe, selbst dann, wenn die InCoax oder ein Lieferant auf die Mglichkeit solcher Sch-

La sustitucin del hardware puede comprarse como parte de los servicios de asistencia tcnica de conformidad con la lista de precios actual. EXCLUSIONES InCoax no garantiza que el funcionamiento de este producto sea ininterrumpido o sin errores. InCoax no es responsable de los daos que se produzcan a consecuen-

cia de que usted no siga las instrucciones destinadas a los productos de hardware. La presente garanta limitada no se aplica a las piezas de desgaste o consumibles, y no se ampla a ningn producto en el que se haya eliminado, daado o quedado defectuoso el nmero de serie:

a) a consecuencia de un accidente, uso indebido, abuso, contaminacin, manteni-

f) debido a la modificacin o el servicio por otra parte que no sea I. InCoax II. un proveedor de servicio autorizado de InCoax InCoax no es responsable de los problemas de interoperabilidad o compatibilidad que puedan surgir en caso de que:

1. se utilicen productos, software u opciones no compatibles con InCoax;

2. se utilicen configuraciones no compatibles con InCoax;

3. se instalen piezas destinadas a un sistema en otro sistema de marca o modelo diferentes LIMITACIN DE RESPONSABILIDAD Si el producto de hardware no funciona segn se garantiza anteriormente, la responsabilidad mxima de InCoax en virtud de la garanta limitada queda limitada expresamente al importe que sea el ms pequeo entre el precio pagado por el producto o el coste de reparacin o sustitucin de los componentes de hardware que funcionen incorrectamente en condiciones de uso normal. RESPONSABILIDADES DEL CLIENTE A fin de permitir a InCoax proporcionar la mejor asistencia tcnica y servicio posible durante el periodo de garanta limitada, deber usted:

Mantener un entorno correcto y adecuado, y utilizar el producto de hardware de conformidad con las instrucciones facilitadas. Verificar las configuraciones, cargar el firmware ms reciente, instalar parches de software, ejecutar diagnsticos y utilidades de InCoax, e implementar proce dimientos o soluciones temporales proporcionados por InCoax mientras InCoax trabaja en encontrar soluciones permanentes. Permitir a InCoax mantener residentes en sus sistemas o emplazamientos deter minadas herramientas de diagnstico y mantenimiento del sistema y la red, a fin de facilitar la ejecucin de la asistencia tcnica en virtud de la garanta. Proporcionar conectividad remota a travs de una lnea de comunicaciones aprobada por InCoax, si fuera necesario. Asistir a InCoax en la ejecucin de las pruebas de servicio. Utilizar la capacidad de transferencia electrnica de datos para informar a InCoax de eventos identificados por el software. Comprar hardware de conexin remota especificado por InCoax para sistema con servicio de diagnstico remoto, si fuera necesario. Utilice las soluciones de asistencia tcnica remota de InCoax cuando proceda. InCoax le recomienda encarecidamente que utilice las tecnologas de asistencia tcnica disponibles proporcionadas por InCoax. Si decide no implementar capacidades de asistencia tcnica remota disponibles, puede incurrir en costes adicionales debido a la mayor necesidad de recursos de asistencia tcnica. Coopere con InCoax para intentar resolver el problema por telfono o correo electrnico. Esto puede incluir ejecutar procedimientos de diagnstico rutinarios, instalar actualizaciones o parches de software adicionales, eliminar opciones de terceros y/o sustituir opciones. Lutente avr diritto di usufruire del servizio di garanzia dellhardware in conformit ai termini e condizioni del presente documento, in caso di riparazione del Prodotto hardware entro il periodo di validit della Garanzia limitata. Durante il periodo di validit della Garanzia Limitata, InCoax potr, a sua discrezione, riparare o sostituire eventuali componenti difettosi. Tutti i componenti o Prodotti hardware sostituiti ai sensi della presente Garanzia limitata saranno di propriet di InCoax. Nellimprobabile eventualit che il Prodotto hardware presenti guasti ricorrenti, InCoax, a sua esclusiva discrezione, potr decidere di:

a) Fornire allutente ununit sostitutiva scelta da InCoax che sia identica o equiva-

lente al Prodotto hardware in termini di prestazioni o b) Rimborsare allutente il prezzo di acquisto o di noleggio (fatta eccezione per gli interessi), anzich inviare ununit sostitutiva. Queste sono le uniche alternative in caso di prodotti difettosi. Il numero del prodotto e il numero di serie dellunit devono essere indicati nella richiesta del servizio di garanzia. In caso contrario, lintervento potrebbe essere considerato fuori garanzia da InCoax o dai fornitori di servizi autorizzati di InCoax e, pertanto, addebitabile al richiedente. Se non diversamente specificato, e nella misura consentita dalla legge locale, i nuovi Prodotti hardware possono essere fabbricati utilizzando nuovi materiali o materiali nuovi e usati equivalenti a quelli nuovi in quanto a prestazioni e affidabilit. InCoax potr riparare o sostituire i Prodotti hardware:

a) Con prodotti o componenti nuovi o usati ma equivalenti a quelli nuovi in quanto a prestazioni e affidabilit, oppure b) Con prodotti equivalenti a un prodotto originale che non pi in produzione Si garantisce che i pezzi di ricambio sono esenti da difetti di materiale o di fabbricazione per novanta (90) giorni, o per il periodo di validit residuo della Garanzia limitata a copertura del Prodotto hardware che sostituiscono o in cui sono installati, adottando il periodo pi lungo. Note:

I. Gli aggiornamenti del firmware non sono coperti dalla presente Garanzia limitata InCoax Condizioni. Il firmware che parte integrante dellhardware non viene aggiornato automaticamente quando ne vengono rilasciate nuove versioni. II. Gli aggiornamenti del firmware si possono acquistare come parte dei Servizi di Assistenza in base al listino prezzi valido al momento dellacquisto. III. I ricambi hardware si possono acquistare come parte del Servizio di Assistenza in base al listino prezzi valido al momento dellacquisto. ESCLUSIONI InCoax non garantisce che il funzionamento del prodotto sar ininterrotto e privo di errori. InCoax non sar responsabile per eventuali danni causati dal mancato rispetto delle istruzioni duso dei Prodotti hardware. La presente Garanzia limitata non si applica ai materiali di consumo e non si estende a prodotti il cui numero di serie stato rimosso, danneggiato o reso difettoso. Inoltre, la Garanzia limitata non si applica nei seguenti casi:

bilit che possono verificarsi se:

1. Vengono utilizzati prodotti, software od opzioni non supportati da InCoax. 2. Vengono realizzate configurazioni non supportate da InCoax. 3. I componenti destinati a un sistema vengono installati su un altro sistema di marca o modello differenti. LIMITAZIONE DI RESPONSABILIT Se il Prodotto hardware non funziona come descritto in precedenza, la massima responsabilit di InCoax ai sensi della Garanzia limitata sar espressamente limitata al prezzo corrisposto per il Prodotto o al costo di riparazione o sostituzione di eventuali componenti hardware che non funzionano correttamente in condizioni di normale utilizzo, quale dei due sia il pi basso. RESPONSABILIT DEL CLIENTE Per consentire a InCoax di fornire la migliore assistenza e servizio possibili durante il periodo di validit della Garanzia limitata, necessario:

Mantenere lambiente in condizioni adeguate e consone e utilizzare il Prodotto hardware in conformit alle istruzioni fornite. Verificare le configurazioni, caricare il firmware pi recente, installare i patch software, eseguire gli strumenti di diagnostica e le utility di InCoax e implementare le procedure temporanee o soluzioni alternative indicate da InCoax, mentre InCoax elabora soluzioni permanenti. Consentire a InCoax di accedere ai propri sistemi o utilizzare determinati sistemi e strumenti di diagnostica e manutenzione di rete per agevolare lesecuzione delle attivit coperte dalla garanzia. Fornire la connettivit remota attraverso una linea di comunicazione approvata da InCoax, ove necessario. Supportare InCoax nellesecuzione dei test di servizio. Utilizzare la funzione di trasferimento elettronico dei dati per informare InCoax degli eventi identificati dal software. Acquistare lhardware di connessione remota specificato da InCoax per sistemi con servizio di diagnostica in remoto, se necessario. Se applicabile, utilizzare soluzioni di supporto remoto InCoax. InCoax consiglia vivamente di utilizzare le tecnologie di supporto disponibili fornite da InCoax. In caso non venissero utilizzate le funzionalit di supporto remoto disponibili, possibile che si incorra a costi aggiuntivi dovuti ai maggiori requisiti richiesti per le risorse di supporto. Per risolvere eventuali problemi, si consiglia di contattare InCoax per telefono o via email per ricevere assistenza. Ci pu comportare lesecuzione di procedure diagnostiche di routine, linstallazione di patch o aggiornamenti software supplementari, la rimozione di opzioni di terzi e/o la sostituzione di opzioni. necessario implementare una procedura per ricostruire i file, i dati o i programmi persi o alterati che non dipendono dal Prodotto hardware coperto dalla garanzia. guire la manutenzione di tali prodotti con la supervisione di InCoax e posticipare lintervento di garanzia finch tali pericoli non sono stati eliminati. InCoax potr richiedere lesecuzione di attivit supplementari definite nellambito di ogni tipo di intervento di garanzia sopra elencato, nonch di qualsiasi altra azione che InCoax possa ragionevolmente richiedere per eseguire al meglio lintervento di garanzia.
