The Commissions grantee code and certification records have been updated on this name change. Screening Eagle requests that certain photographs showing the interior of the device be withheld from public disclosure. The Commission has previously granted confidentiality under similar conditions to the application by Mala GeoScience AB for FCC ID: QLA250MHZ, and numerous applications submitted by Geophysical Survey Systems, Inc., including:

FACTUAL BASIS FOR CONFIDENTIALITY REQUEST Ordinarily, the Commission denies confidentiality to internal photographs of a device submitted for equipment authorization on the ground that they contain information that is freely available to a competitor by simply purchasing the device and removing the cover. However, the UWB device in question is different as the interior components are packed tightly into a very small form factor that cannot opened without damaging and disabling the device. To gain access to the views shown in the interior photographs of the device, a competitor would have to purchase the device and then carry out the following steps:
1. Obtain and use a custom security screwdriver available only from Screening Eagle, to remove the tamper-proof screw securing the cover. The custom screwdriver is only sold to Screening Eagle partners and is never given to Mr. Ronald Repasi Page 2 customers. Without the custom screwdriver to access the interior of the product, it would require destroying parts of the device antenna. 2. Disassemble various electronic assemblies in a careful and proper order manner to prevent irreversible damage to the components. To access certain electronics of the antenna is would be necessary to remove the frontend carefully from the shielding. When these steps are done improperly, the electronics can be severely damaged. A lot of clever mechanical engineering effort has gone into packing everything so tightly in such a small form factor. The device is also not user-serviceable and cannot reliably be restored to its original operating condition once it is opened by someone other than Screening Eagle with the right tools, care, and knowledge regarding its intricate assembly process. Screening Eagle has not released instructions on how to disassemble its units as it keeps such information internal to the company. The posting of internal photographs on the Commissions web site would allow a competitor to bypass this difficult disassembly and allow it to determine how Screening Eagle managed to pack SFCW UWB electronics into such a small form factor and still maintain the achieved levels of performance. Competitors could also use such information to assist in determining the relative costs of manufacturing, the man-hours required for device construction and assembly and the compatibility/incompatibility with other designs which in effect would greatly simplify a reverse engineering of the product. Screening Eagle respectfully submits that it should not be required to hand over to competitors, the fruits of it many years of expensive engineering. II. LEGAL BASIS FOR REQUEST The Freedom of Information Act (FOIA) protects from disclosure commercial or financial information obtained from a person and privileged or confidential.1 Information is confidential if it is the kind of information that would customarily not be released to the public by the person from whom it was obtained,2 and would cause substantial harm to the competitive position of the person from whom the information was obtained.3 In Worthington Compressors, the D.C. Circuit addressed the specific issue underlying the present request, to wit, the additional wrinkle that the requested information is available, at some cost, from an additional source.4 Here, of course, the additional source is the acquisition, disassembly and destruction of a Proceq device for inspection. Mr. Ronald Repasi Page 3 of the information through alternate sources triggers two additional inquiries: (1) the commercial Importantly, the court acknowledged that the submitting party can suffer competitive harm if the information has commercial value to competitors,5 as would be the case for interior photographs that disclosed a great deal of expensive and proprietary engineering. Further, the court said that if competitors can acquire the information [by other means] only at considerable cost, agency disclosure may well benefit the competitors at the expense of the submitter.6 The court went on to note that competitors may get quite a bargain and a potential windfall if they can acquire hard-won proprietary information at FOIA retrieval costs7 and that [s]uch bargains could easily have competitive consequences not contemplated as part of FOIAs principal aim of promoting openness in government.8 In the case of photos posted on the Commissions website, a competitor need not even file an FOIA request but can simply download the material at no cost whatsoever. The cost of acquiring interior photographs, if they are not available on the Commissions website, amounts to the retail cost of a UWB unit and the time and effort required for complete disassembly. Although this may not amount to a large expenditure of money in absolute terms, it is still a significant expenditure for a small company, and most UWB manufacturers are small companies. This fact alone warrant protection from disclosure under applicable court precedent. III. CONCLUSION Federal case law protects information submitted to an agency and (1) withheld from the public; (2) capable of causing substantial competitive harm to the submitter; and (3) expensive to acquire by other means. Unlike many other product photographs, the interior photographs of Screening Eagles UWB devices meet all of these criteria, and therefore are entitled to protection against public disclosure. Importantly, Screening Eagle does not request a final ruling on the issue at this time. It asks only that the Commission refrain from posting any internal photographs on its website pursuant to Section 0.459(d)(1), unless and until the Commission receives a properly framed request for inspection of the photographs, so that Screening Eagle is given an adequate opportunity to challenge their release. 5 Id. 6 Id. 7 Id. 8 Id. 1. By this Order, we grant a request by Proceq USA Inc. (Proceq), for a waiver of our rules governing unlicensed ultra-wideband (UWB) devices to permit the certification and marketing of its ground penetrating radar (GPR) device.1 Proceq is a manufacturer of devices that enable the non-
destructive testing of materials such as concrete, metals, rock and composites. We find that this device operating under the specified waiver conditions poses no greater risk of causing harmful interference to communication services than those devices already permitted under the existing rules and that grant of the waiver will serve the public interest. 2. In 2002, the Commission adopted regulations to permit the operation of UWB transmitters, including GPR systems.2 These transmitters operate using spectrum that is allocated to various radio services, including frequency bands that are allocated to both Federal and to non-Federal operations.3 They also operate in several restricted frequency bands within which the operation of other types of Part 15 transmitters are prohibited.4 As with all unlicensed devices, these UWB devices share these frequency bands with authorized radio services on a sufferance basis and may not cause harmful interference to authorized radio services.5 Our specific UWB technical and operational rules are designed to ensure that UWB GPR devices do not cause harmful interference to authorized radio services, including Federal services. On September 11, 2017, Proceq filed a waiver request to allow the marketing and operation of a fast-stepping continuous-wave ground penetrating radar device that is claimed to provide increased performance in determining the safety and stability of materials. Proceq states that its GPR device implements an algorithm that is based on stepped frequency continuous-wave (CW) modulation to suppress RF interference from Wi-Fi and GSM sources that it asserts can often impede the performance of conventional GPR devices.7 To accommodate this system design, Proceq seeks a waiver of our rules pertaining to the definition and measurement procedure. 4. We are authorized to grant a waiver under Section 1.3 of the Commission's rules if the petitioner demonstrates good cause for such action.8 Good cause, in turn, may be found and a waiver granted where particular facts would make strict compliance inconsistent with the public interest.9 To make this public interest determination, the waiver cannot undermine the purpose of the rule, and there must be a stronger public interest benefit in granting the waiver than in applying the rule.10 We find that this standard has been met. 5. Section 15.503(d) of the Commissions rules defines a UWB transmitter as a device that at any point in time has an UWB bandwidth equal to or greater than 500 megahertz or a fractional bandwidth equal to or greater than 0.20. The Proceq device steps a narrow signal through the 200 to 4000 MHz range. Each of these individual transmissions is less than 500 megahertz in bandwidth at any point in time and Proceqs device does not have a 0.20 or greater fractional bandwidth. Thus, even though the device has a total bandwidth that exceeds 500 megahertz, it would not meet the definitional requirement for operation under the UWB rules.11 6. The UWB imaging rules were designed to accommodate devices that emit impulsive or transient-like signals that are spread across a very wide bandwidth to produce an image of objects within the ground or other materials.12 The primary difference between the Proceq device and other UWB GPR devices provided for in the rules is that the Proceq GPR device uses stepped frequency CW modulation i.e., an array of closely spaced transmitting/receiving antennas that transmit sequentially over a large band of spectrumto gather all the needed data. This modulation scheme is functionally equivalent to other types of UWB GPR devices in that it uses transient-like signals spread across a wide bandwidth. The risk of interference from the Proceq GPR device in this scenario is no greater than that from other such UWB 6 47 C.F.R. 15.509(b) 7 See Proceq Waiver request at 2. Accordingly, we find that a waiver will not undermine the intent of our rule. 7. Section 15.31(c) of the Commissions rules, sets forth the measurement standards for unlicensed devices to demonstrate compliance with applicable emissions limits. This rule requires that swept frequency equipment measurements shall be made with the frequency sweep stopped. Section 15.521(d) of the Commissions rules, 47 C.F.R. 15.521(d), sets forth the measurement procedures for UWB devices to demonstrate compliance with applicable emissions limits. For emissions above 960 MHz, this rule requires that, if pulse gating is used and the transmitter is quiescent for longer intervals than the nominal pulse repetition interval, measurements are made with the pulse train gated on. Proceq observes that, since this rule was adopted, the Commission has permitted other UWB transmitters operating above 960 MHz that use frequency stepping techniques to be measured using an average detector with the transmitter operating in its normal mode, i.e., with the stepping function active, and asserts that there is no reason to require it to conduct measurements with the stepping function stopped.13 Proceq claims that its GPR device will meet all other emission limits and technical requirements under the UWB rules when measured with the stepping function active. 8. Prior waivers of the measurement procedures for UWB transmitters that permitted emissions to be measured with the transmitter operating in its normal transmission mode recognized that the interference aspects of a transmitter employing frequency hopping, frequency stepping, or gating are quite similar, as viewed by a receiver, in that transmitters using these burst formats appear to the receiver to emit for a short period of time followed by a quiet period.14 The Commission concluded that any requirement to stop the frequency hopping, band sequencing, or system gating serves only to add another unnecessary level of conservatism to already stringent UWB standards.15 In conjunction with the National Telecommunications and Information Administration (NTIA), we have further determined that allowing stepped frequency devices to be measured with the stepping function on would not increase the interference potential of the device above that of impulse UWB devices if all other emission limits and technical requirements are met.16 9. Proceqs request represents an analogous situation. Because a waiver of the measurement procedures in Sections 15.31(c) and 15.521(d) will not increase the potential for harmful interference to authorized services, permitting Proceq to demonstrate compliance with the UWB GPR emission limits with the stepping function active will not undermine the purpose of the rule.17 To ensure that the Proceq GPR device does not emit in any individual 10 MHz, 20 MHz, or 40 MHz narrow band continuously, we are conditioning this waiver so that the dwell time during any step shall not exceed 0.04 percent of the devices minimum scan/cycle rate.18 In sum, we find that Proceqs GPR device operating under the conditions specified below poses no greater risk of causing harmful interference to radio communications services than any other UWB imaging system operating under our rules. 13 See Proceq Waiver Request at 9-10 (citing Petition for Waiver of the Part 15 UWB Regulations Filed by the Multi-band OFDM Alliance Special Interest Group, ET Docket No. 04-352, Order, 20 FCC Rcd 5528 (2005)

We also find that granting a waiver is in the public interest. GPRs have a wide variety of applications for locating objects under ground. Providing for a variety of GPR technologies will increase competition, enabling potential users to have more choices to obtain the products that best meet their needs. 11. Our waiver is limited to the Proceq GPR device and its use as described in the waiver request and applies to: 1) The at any point in time requirement of Section 15.503(d) which would require the Proceq transmitter to have a fractional bandwidth equal to or greater than 0.20 or UWB bandwidth equal to or greater than 500 MHz; and 2) the requirements in Sections 15.31(c) and 15.521(d) which directs that the emissions from the Proceq GPR device to be measured with the transmitter operating with the stepping function stopped. The waiver is also subject to the following conditions:
The Proceq GPR device shall be certified by the Commission.19 The Proceq GPR device shall operate with stepped frequency CW modulation in 10, 20 or 40 megahertz steps between 200 and 4000 MHz. The Proceq GPR device dwell time on any one frequency shall not exceed 2 microseconds. The dwell time during any step of the Proceq GPR shall not exceed 0.04 percent of the devices minimum scan/cycle rate. For certification testing, the measurement of emissions from the Proceq GPR device shall be conducted with the stepping function active for all possible frequency step sizes. The Proceq GPR device will comply with all other technical and operational requirements applicable to UWB GPR devices under Part 15, Subpart F of the Commissions rules. The entities permitted to operate the Proceq GPR device are limited to those specified in Section 15.509(b) of the Commissions rules. The conditions established for this waiver are not applicable to mass marketed UWB GPR devices where further analysis would be necessary to assess the potential impact to authorized users. 12. Accordingly, pursuant to authority in Sections 0.31, 0.241, and 1.3 of the Commissions rules, 47 C.F.R. 0.21, 0.241, and 1.3, and Sections 4(i), 302, 303(e), and 303(r) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 302, 303(e), and 303(r), IT IS ORDERED that the Request for Waiver filed by Proceq USA Inc., IS GRANTED, consistent with the terms of this Order. (Proceq), the Office of Engineering and Technology (OET) is granting your request to modify an existing waiver to accommodate the operation of Proceqs Ultra-Wideband (UWB) ground penetrating radar device across a wider frequency range. On March 14,2018. OET granted a waiver of Section 15.3 1(c) of the FCC rules to allow the radio frequency emissions from Proceqs device to be measured in the active mode of operation rather than with the stepping function stopped. Changing the upper frequency range of the Proceq GPR from 4000 MHz to 6000 MHz is consistent with spectrum currently available for GPR devices7 and does not alter the technical and operational conditions included in the existing waiver that we previously determined were sufficient to protect other spectrum users.8 Proceq will continue to be subject to those conditions, which ensures that operation of its new device across the expanded frequency range will not introduce new risks of causing harmful interference to communications services. We further recognize that Proceqs new device will offer expanded public interest benefits, including higher resolution scanning that will enable more sophisticated applications. To give effect to our decision, we revise the second condition of the existing waiver to read as follows: The Proceq GPR device shall operate with stepped frequency CW modulation in 10, 20 or 40 megahertz steps between 200 and 6000 MHz. All other conditions associated with the waiver continue to apply without alteration. Accordingly, pursuant to authority delegated in Sections 0.31 and 0.241 AND 1.3 of the Commissions rules, 47 C.F.R 0.31, 0.241, and 1.3, and Sections 4(i), 302, 303(e), and 303(r) of the Communications Act of 1934, as amended, 47 U.S.C 154(i), 302, 303(e), and 303(r), IT IS ORDERED that the waiver issued to Proceq by Order dated March 14, 2018, is hereby modified as described above effective upon release of this Order. In September 2017, Proceq had filed a request for waiver of sections 15.503(d), and 15.31(c) of the Commissions Part 15 ultra-wideband (UWB) rules to market its Proceq GPR Live.2 The original Order granting the waiver allowed Proceq to operate on stepped frequency continuous-wave modulation and would transmit between 200 and 4000 MHz3, with the step sizes of 10, 20, and 40 MHz, and dwell time of 2 micro-seconds.4 In September 2019, Proceq filed a request to modify the waiver, requesting an increase of the operating bandwidth by extending the upper transmit frequency limit by 2000 MHz, to operate between 1 Proceq USA Inc. Even though we are outside of the time requirement, this rule is rarely enforced and therefore we should proceed with the name change updates as soon as possible to make sure the FCC records are accurate. There are several things we need to do:
1) Change the Grantee Name for Grantee Code 2ANPE. We need the following information to proceed:

Regarding the waivers, KDB Publication No. 502150 states that the name change has to be submitted to the equipment authorization system (Grantee Name Change, mentioned in (1) above) before any new equipment authorization applications are submitted. I have also contacted the FCC to conrm if there is anything else that needs to be done in regards to the waivers, but I have not heard back yet. We should proceed with (1) and (2) above while awaiting a response from the FCC. Once I have the information needed for (1) and (2) above, I will prepare a draft ling for your review, before submitting the name change to the FCC. I. INTRODUCTION 1. By this Order, we grant a request by Proceq USA, Inc. (Proceq) for a modification of a previously granted waiver of our rules governing unlicensed ultra-wideband (UWB) devices to permit the certification and marketing of the newest update of its UWB ground penetrating radar (GPR). We find that opening a path for the sale and operation of this next generation equipment will allow Proceq to deploy its system to enhance the GPR capabilities for soil contact construction material assessment, in furtherance of the public interest; and that operation of this device under the specified waiver conditions poses no greater risk of causing harmful interference to communication services than those devices already permitted under the existing rules. II. BACKGROUND 2. On September 11, 2017, Proceq filed a request for waiver of the measurement procedures found in sections 15.503(d), 15.31(c), and 15.521(d) of the Commissions Part 15 ultra-wideband (UWB) rules to market its Proceq GPR Live.1 The device is a UWB ground penetrating radar that is used to test the safety, durability, and sustainability of materials such as concrete, metal, rock, and composites used in industrial settings.2 The Office of Engineering and Technology (OET) concluded that the request made by Proceq was analogous to prior waivers of measurement procedures that had been previously granted to other manufacturers of UWB devices.3 It also determined that because a waiver of the measurement procedures will not increase the potential for harmful interference to authorized services, permitting 1 Proceq USA Inc. Federal Communications Commission DA 22-1158 Proceq to demonstrate compliance with the UWB GPR emission limits with the stepping function active would not undermine the purpose of the rule.4 The original Order granting the waiver required Proceq to operate on stepped frequency continuous-wave modulation and to transmit between 200 and 4000 MHz with the step sizes of 10, 20 and 40 MHz and a dwell time not to exceed of 2 micro-seconds.5 OET also imposed a condition that the dwell time during any step shall not exceed 0.04 percent of the devices minimum scan/cycle rate.6 3. On May 17, 2019, Proceq filed a request to modify the waiver.7 Proceq sought an increase of the operating bandwidth by extending the upper transmit frequency limit by 2000 MHz, such that operation would occur between 200 MHz and 6000 MHz instead of 200 MHz and 4000 MHz under the original waiver.8 On September 11, 2019, OET subsequently granted this modification request.9 4. On February 4, 2020, Proceq filed a new request to modify the waiver, seeking to further increase the devices operating bandwidth.10 It sought to extend the operating frequency range from 200-
6000 MHz to 30-8000 MHz and vary the frequency steps from 1 - 40 MHz, which Proceq claims will result in improved resolution and technical performance for the device. In addition, Proceq asked to include Orthogonal Frequency Division Multiplexing (OFDM) as a part of its modulation scheme.11 5. On May 7, 2020, OET sought comment on Proceqs request.12 The comment cycle ended on June 23, 2020. Two parties aside from Proceq filed substantive comments in the docket that directly address Proceqs request: Vortezon, Inc. filed general comments in support of the request.13 The GPS Innovation Alliance (GPSIA) does not oppose granting the specific waiver request, but suggests that the Commission limit certain aspects of this device, including rejecting or severely restricting Proceqs efforts to introduce OFDM in frequency bands associated with GPS operations.14 GPSIA also expresses general concerns about the Commissions rule waivers affecting UWB devices due to the proximity of some 4 Id. 5 Id. 6 See id. On April 22, 2022, Proceq provided additional information about the Second Waiver Modification Request, including documenting its desire to withdraw the portion of its request that would extend the upper operating range of its device from 6000 MHz to 8000 MHz.17 Thus, Proceq now seeks to operate in the 30-6000 MHz frequency range. III. DISCUSSION 7. We are authorized to grant a waiver under Section 1.3 of the Commission's rules if the petitioner demonstrates good cause for such action.18 Good cause, in turn, may be found where particular facts would make strict compliance inconsistent with the public interest.19 To make this public interest determination, the waiver cannot undermine the purpose of the rule, and there must be a stronger public interest benefit in granting the waiver than in applying the rule.20 The UWB standards in Part 15 were adopted to ensure that UWB devices, including GPRs, do not cause harmful interference to authorized radio services, including those operated by the Federal Government.21 We find that the particular circumstances that supported the grant of the Waiver Order and the subsequent Modification Order also support our grant of this relatively minor modification of the waiver for the Proceq Live device as requested by Proceq. With appropriate operational and technical limitations, granting Proceqs request to modify its waiver poses no greater risk of causing harmful interference to radio communications services than any other GPR device operating under our rules. In addition, we find that there is a stronger public interest benefit in granting this waiver than in strictly applying the rules. 8. As we stated in the Waiver Order, this waiver presents a compelling public interest situation in providing for a variety of GPR technologies that will increase competition, which in turn will provide potential users with more choices to obtain the products that best meet their needs. 22 We acknowledge Proceqs continued efforts to improve upon its technology and conclude that, in furtherance of achieving this desirable goal, it is reasonable and appropriate for us to accommodate the additional technical changes that improve the accuracy and efficiency of Proceqs GPR product. As we have previously determined, these GPRs present an extremely small risk of harmful interference to other authorized operations.23 Given the remote likelihood of such interference, we find that grant of this waiver modification will not contravene the underlying purpose of Sections 15.503(d), 15.31(c), 15.521(d) of the Rules. 9. In its comments, GPSIA raised concerns that Proceqs device modifications could potentially cause harmful interference to GNSS receivers and other protected services.24 In this and other UWB proceedings, GPSIA has noted the importance of GPS and GNSS operations, and has consistently sought to ensure that there is sufficient technical and operational information for it to assess how a proposed waiver will affect its interests. In this instance, GPSIA contended that because Proceqs proposal would shift from discrete frequencies to clustered stepping and introduce new operations in the GNSS band, it wanted to more fully understand Proceqs planned operations, including the power levels associated with Proceqs operations within the GNSS band, before determining whether it would oppose the request.25 In reply, Proceq stated that the different characteristics and functions of its GPR devices represent normal evolutionary product changes that would otherwise be permitted under the equipment certification procedures.26 Proceq also comments that it will fully comply with all UWB rules in all authorized bands and the Commissions certification process will ensure this to be the case.27 As a reference, Proceq asserts that MBOA-SIG applied for and received a waiver of the same two rules at issue in Proceqs pending Petition for a UWB OFDM communications system.28 More recently, GPSIA filed ex parte submissions documenting the status and ultimate resolution of its concerns. On August 1, 2022, it met with Commission staff to reiterate its request for more specific details on the operation of the Proceq device.29 Shortly thereafter, it reported that it had had productive, constructive, and transparent discussions with Proceq, and that based on its more complete understanding of Proceqs device and limited scope of operations (i.e., for underground utility detection and not for broader communications means), it does not object to the grant of Proceqs current request for waiver modification.30 Based on this filing as well as the information previously submitted in the docket, we now proceed to consider the pending request. 10. We find that the waiver standard has been met. In the Waiver Order, we found the primary difference between the Proceq device and other UWB GPR devices provided for in the rules to be that the Proceq GPR device uses stepped frequency CW modulationi.e., an array of closely spaced transmitting/receiving antennas that transmit sequentially over a large band of spectrumto gather all the needed data.31 OET also determined that this modulation scheme was functionally equivalent to other 23 Id. 33 FCC Rcd at 2260. 24 See GPSIA comments at 6-7. 25 Id. 26 See Proceq reply comments at 3-4. 27 Id. at 3. 28 Id. See Waiver Order, 33 FCC Rcd at 2259-2260. 4 Federal Communications Commission DA 22-1158 types of UWB GPR devices in that it uses transient-like signals spread across a wide bandwidth.32 Similarly, OFDM is a transmission scheme whereby the data stream is split into brief transmissions over multiple overlapping channels spanning a wide swath of spectrum. Here, for the same reasons as we have previously determined for stepped frequency CW modulation, we find that including OFDM in UWB devices under certain requirements is functionally equivalent to other types of UWB GPR.33 It has long been understood that incorporating OFDM into UWB devices is an acceptable practice.34 In addition, changing the frequency range of the Proceq GPR from 200-6000 MHz to 30-6000 MHz is consistent with spectrum currently available for GPR devices. We find it important to reiterate that Proceq is not requesting any new rule sections be waived that it has not previously sought. Accordingly, consistent with our earlier actions with respect to this matter, we find good cause to modify the waiver of Section 15.503(d), 15.31(c), and 15.521(d) of our rules for the Proceq devices as requested. 11. We agree with Proceq that the duty cycle and dwell time set forth in the original waiver was deemed to be sufficient not to introduce an increased risk of harmful interference.35 As an added measure to mitigate the potential for harmful interference the energy from the GPR will be directed at the soil and other soil contact materials. The majority of the energy will be attenuated by these materials resulting in a lower potential for harmful interference. We note that Proceq is not requesting a waiver of the existing power limits and will be required to meet the Part 15 emission limits for UWB. For these reasons, we conclude that with the conditions previously imposed and those we impose herein, the Proceq device can operate without a significant risk to incumbent services.36 IV. SCOPE OF DECISION 12. This Order is narrowly tailored to address the particular facts relevant to the Proceq device and is conditioned on Proceq meeting the specified waiver conditions. In doing so, as with every waiver request, we address the circumstances particular to the request before us. Therefore, we agree with GPSIA on the need to carefully evaluate future Part 15 UWB waivers based on the specific and unique circumstances associated with each application.37 It is beyond the scope of this Order, however, to establish a new precedent for UWB rule waiver applicants to provide specific technical information in their petitions, as GPSIA has asked.38 Applicants have broad flexibility in how they choose to structure their petitions. As a practical matter, because parties must submit sufficient information to mitigate the risk of delayed consideration or outright dismissal of their petitions, there is ample incentive for them to make their filings as complete and detailed as practical. The general concerns about issuing future Part 15 UWB waivers that GPISA has raised in its comments are beyond the scope of this particular proceeding, but remain available for our future consideration as appropriate and necessary. V. MODIFIED WAIVER CONDITIONS. 13. FACTUAL BASIS FOR CONFIDENTIALITY REQUEST Ordinarily, the Commission denies confidentiality to internal photographs of a device submitted for equipment authorization on the ground that they contain information that is freely available to a competitor by simply purchasing the device and removing the cover. However, the GPR device in question is different as the interior components are packed tightly into a very small form factor that cannot opened without damaging and disabling the device. To gain access to the views shown in the interior photographs of the Proseq device, a competitor would have to purchase the device and then carry out the following steps:
Obtain and use a custom security screwdriver available only from Proceq, to 1. remove the tamper-proof screw securing the cover. The custom screwdriver is only sold to Proceq partners and is never given to customers. Without the custom screwdriver to access the interior of the product, it would require destroying parts of Mr. Julius Knapp Page 2 Disassemble various electronic assemblies in a careful and proper order the device antenna. 2. manner to prevent irreversible damage to the components. To access certain electronics of the antenna is would be necessary to remove the frontend carefully from the shielding. When these steps are done improperly, the electronics can be severely damaged. A lot of clever mechanical engineering effort has gone into packing everything so tightly in such a small form factor. The device is also not user-serviceable and cannot reliably be restored to its original operating condition once it is opened by someone other than Proceq with the right tools, care, and knowledge regarding its intricate assembly process. Proceq has not released instructions on how to disassemble its units as it keeps such information internal to the company. The posting of internal photographs on the Commissions web site would allow a competitor to bypass this difficult disassembly and allow it to determine how Proceq managed to pack SFCW GPR electronics into such a small form factor and still maintain the achieved levels of performance. Competitors could also use such information to assist in determining the relative costs of manufacturing, the man-hours required for device construction and assembly and the compatibility/incompatibility with other designs which in effect would greatly simplify a reverse engineering of the product. Proceq respectfully submits that it should not be required to hand over to competitors, the fruits of it many years of expensive engineering. II. LEGAL BASIS FOR REQUEST The Freedom of Information Act (FOIA) protects from disclosure commercial or financial information obtained from a person and privileged or confidential.1 Information is confidential if it is the kind of information that would customarily not be released to the public by the person from whom it was obtained,2 and would cause substantial harm to the competitive position of the person from whom the information was obtained.3 In Worthington Compressors, the D.C. Circuit addressed the specific issue underlying the present request, to wit, the additional wrinkle that the requested information is available, at some cost, from an additional source.4 Here, of course, the additional source is the acquisition, disassembly and destruction of a Proceq device for inspection. According to the Worthington court, availability of the information through alternate sources triggers two additional inquiries: (1) the commercial value of the information, and (2) the cost of acquiring the information through the other means.5 1 5 U.S.C. 552(b)(4). 2 McDonnell Douglas Corp. v. Mr. Julius Knapp Page 3 Importantly, the court acknowledged that the submitting party can suffer competitive harm if the information has commercial value to competitors,6 as would be the case for interior photographs that disclosed a great deal of expensive and proprietary engineering. Further, the court said that if competitors can acquire the information [by other means] only at considerable cost, agency disclosure may well benefit the competitors at the expense of the submitter.7 The court went on to note that competitors may get quite a bargain and a potential windfall if they can acquire hard-won proprietary information at FOIA retrieval costs8 and that [s]uch bargains could easily have competitive consequences not contemplated as part of FOIAs principal aim of promoting openness in government.9 In the case of photos posted on the Commissions website, a competitor need not even file an FOIA request but can simply download the material at no cost whatsoever. The cost of acquiring interior photographs, if they are not available on the Commissions website, amounts to the retail cost of a GPR unit and the time and effort required for complete disassembly. Although this may not amount to a large expenditure of money in absolute terms, it is still a significant expenditure for a small company, and most GPR manufacturers are small companies. This fact alone warrant protection from disclosure under applicable court precedent. III. CONCLUSION Federal case law protects information submitted to an agency and (1) withheld from the public; (2) capable of causing substantial competitive harm to the submitter; and (3) expensive to acquire by other means. Unlike many other product photographs, the interior photographs of Proceqs GPR devices meet all of these criteria, and therefore are entitled to protection against public disclosure. Importantly, Proceq does not request a final ruling on the issue at this time. Proceq asks only that the Commission refrain from posting any internal photographs on its website pursuant to Section 0.459(d)(1), unless and until the Commission receives a properly framed request for inspection of the photographs, so that Proceq is given an adequate opportunity to challenge their release.
